These Terms & Conditions apply to all users of dawadawai.in and the Dawa Dawai mobile application (collectively referred to as "Platform", "we," "us," or "our"). By using this Platform, you agree to follow these terms. If you do not agree with any part of these terms, please do not use our Platform.

We reserve the right to update or modify these terms at any time without prior notice. Continued use of the Platform after changes constitutes acceptance of the revised terms.

We strive for the highest accuracy in our product listings. However, please note the following:

• Prescription Requirements: Certain medicines marked as "Rx" require a valid prescription from a registered medical practitioner (MBBS/BDS/BAMS/BHMS or equivalent). We reserve the right to cancel orders if a valid prescription is not provided or is found to be fraudulent. Prescription verification is mandatory before dispatch of Rx medicines.
• Product Representation: Packaging, colors, and appearance of products may vary slightly from images displayed on the Platform due to manufacturer updates, batch variations, or screen display settings. Such variations do not affect the quality or efficacy of the product.
• Availability: All products are subject to stock availability. In case of non-availability, we will notify you and offer suitable alternatives or a full refund.
• Modifications: We reserve the right to modify, update, or discontinue any product, service, or feature at any time without prior notice.
• Ayurvedic & Veterinary Products: Ayurvedic and veterinary products are sold as per manufacturer guidelines. Users must read product labels and consult relevant practitioners before use.

All prices listed on dawadawai.in are in Indian Rupees (INR/₹).

• Prices include applicable taxes (GST) unless stated otherwise.
• Delivery charges, if applicable, are displayed separately at checkout.
• In the event of a technical error where a product is listed at an incorrect price, we reserve the right to cancel any orders placed for that product and issue a full refund.
• We offer competitive pricing, but prices may change without prior notice due to market conditions or supplier updates. The price at the time of order placement is final.

• Upon placing an order, you will receive an acknowledgment via SMS, WhatsApp, or app notification. This does not constitute final acceptance of the order.
• Final acceptance occurs once the order is verified by our pharmacists (including prescription verification for Rx items) and dispatched for delivery.
• We reserve the right to refuse or cancel orders due to:
  • Product unavailability
  • Inaccuracies in pricing or product information
  • Invalid, expired, or fraudulent prescriptions
  • Suspicion of fraudulent activity or misuse of medication
  • Delivery location outside our serviceable area
• We currently deliver across Jamui, Malaypur, Gidhaur, Jhajha, Sono, Barhat, Khaira, Chakai, Laxmipur, Sikandra, and nearby areas within Bihar.

• Standard Delivery (Jamui town): 30-45 minutes during operating hours (8 AM - 10 PM).
• Surrounding Areas: 1-3 hours depending on distance and availability.
• Orders placed after 8 PM may be delivered the next morning.
• Delivery is FREE for orders above ₹299. For orders below ₹299, a delivery charge of ₹30 (local) or ₹60 (extended areas) applies.
• You must provide accurate delivery address and be available to receive the order. Our delivery partner will make up to 2 delivery attempts.
• All medicines are packed in appropriate conditions to maintain efficacy. Cold-chain medicines are delivered in insulated packaging.

We offer secure payment options, including:

• Cash on Delivery (COD) — subject to eligibility (minimum 3 completed prepaid orders, 50% COD split)
• UPI (Google Pay, PhonePe, Paytm, BHIM)
• Credit/Debit Cards
• Net Banking
• WhatsApp Order (payment on delivery or via UPI)

All online payments are processed through secure, PCI-DSS compliant payment gateways. We do not store your card or banking details on our servers.

• Online doctor consultations are facilitated through our Platform with verified, registered medical practitioners.
• Consultation fees are non-refundable once the consultation has commenced.
• Cancellation is allowed up to 2 hours before the scheduled consultation time for a full refund.
• The consultation service is for general medical advice only and does not replace in-person medical examination where necessary.
• Prescriptions issued through our Platform are valid for purchase of medicines through Dawa Dawai Pharma.
• Patient information shared during consultations is kept strictly confidential as per our Privacy Policy.

You agree not to misuse dawadawai.in or the Dawa Dawai app. Prohibited activities include:

• Unauthorized access, hacking, or attempting to breach security systems.
• Uploading malware, viruses, or any malicious code.
• Providing false personal information or fraudulent prescriptions.
• Placing orders with intent to resell medicines commercially.
• Using the Platform in any manner that violates applicable local, state, or national laws.
• Impersonating another person or entity.

Violation of these terms may result in immediate termination of access and potential legal action under applicable Indian laws.

All content on this Platform, including but not limited to the Dawa Dawai brand name, logo (दवा दवाई), images, text, graphics, software, and design, is the exclusive property of Dawa Dawai Pharma and is protected under Indian copyright, trademark, and intellectual property laws.

Unauthorized reproduction, distribution, modification, or commercial use of any content from this Platform is strictly prohibited and may result in legal action.

Your data security is paramount to us. Your use of this Platform is governed by our Privacy Policy, which details how we collect, use, store, and protect your personal and medical information.

By using this Platform, you consent to the collection and use of your information as described in our Privacy Policy.

Dawa Dawai Pharma shall not be held liable for:

• Indirect, incidental, consequential, or punitive damages arising from use of the Platform.
• Adverse reactions, side effects, or health issues arising from the use or misuse of products purchased through the Platform.
• Delays in delivery due to circumstances beyond our control (weather, strikes, natural disasters, government orders).
• Information provided on the Platform which is intended for educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
• Third-party links, products, or services referenced on the Platform.

Users are advised to always consult a qualified healthcare professional before starting, stopping, or modifying any medication.

You agree to indemnify, defend, and hold harmless Dawa Dawai Pharma, its directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Platform, violation of these terms, or infringement of any third-party rights.

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or relating to these terms or the use of dawadawai.in shall be subject to the exclusive jurisdiction of the courts in Jamui, Bihar, India.

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
